"Today’s ruling from the High Court was about legal technicalities – it was not about the morality, the common sense or the human importance of ending marriage discrimination,"
I agree completely.
As sad as this decision is and how devastating it must be for those couples who decided to get married in that 5 day window, i must say, these results are nothing if predictable. Being a law student i had the knowledge that in the constitution it is stated, “if state law is passed that conflicts with federal law, federal law will always prevail”, basically its saying that federal law will always win, which as you see, it has.
I understand how truly sad it is that things had to happen this way but im extremely proud of the ACT assembly for taking the initiative in making the first step forward for this bill, you have allowed it to become real and show that it has a fighting chance so it is no longer deniable.
Ive been reading articles and one thing ive been finding is the constant call for the government to legislate on this area, as much as i agree they should, we have waited many years for them to make a step forward and help our community to no avail. With both the liberal and labor parties advocating against the Same-Sex marriage equality bills i believe it is not waiting for legislation from the federal government we should be calling for, but Referendum, leave this decision for the people, up to the people.
